Terms of Use

Please read these Terms of Use ("Terms") carefully before using tenderspot.in (the "Platform") operated by Tenderspot ("we", "us", or "our"). By accessing or using the Platform you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Acceptance of Terms
By creating an account or using any feature of the Platform, you represent that you are at least 18 years old, have legal capacity to enter into a binding contract, and are authorised to act on behalf of the company or individual you represent. Use of the Platform by persons under 18 is not permitted.
2. Description of the Platform
Tenderspot is a government tender aggregation and intelligence service. It:
- Aggregates publicly available tender notices from government e-procurement portals including GeM, CPPP, CPWD, and state portals.
- Uses AI to clean, categorise, summarise, and enrich tender data.
- Matches tenders to your company profile using vector similarity and eligibility rules.
- Generates AI-assisted bid document drafts for your review.
- Sends email alerts for matched and deadline-approaching tenders.
Tenderspot is an information and productivity tool only. We do not submit bids, sign documents, or enter into contracts on your behalf. All submissions on government portals must be made by you directly.
3. Eligibility
The Platform is intended for use by businesses, sole proprietors, and professionals seeking to participate in Indian government procurement processes. By using the Platform you represent that you are acting in a commercial or professional capacity, not as a consumer.
4. Your Account
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at support@tenderspot.in if you suspect unauthorised access to your account.
- You must not share your account with third parties or create multiple accounts for the same entity.
- We reserve the right to suspend or terminate accounts that we reasonably believe are being misused.
5. Acceptable Use
You agree not to:
- Scrape, copy, or systematically extract data from the Platform by automated means without our prior written consent.
- Use the Platform to submit false, misleading, or fraudulent tender applications.
- Reverse-engineer, decompile, or attempt to extract the source code of the Platform.
- Use the Platform for any unlawful purpose or in violation of any applicable Indian law, including the Information Technology Act, 2000 and the DPDP Act, 2023.
- Circumvent or attempt to bypass any security, rate-limiting, or access-control feature of the Platform.
- Republish or resell tender data obtained from the Platform as a standalone service without a written licence from us.
- Upload or transmit any malicious code, spam, or content that infringes the rights of any third party.
6. AI-Generated Content Disclaimer
Several features of the Platform — including tender summaries, eligibility notes, Win Probability Scores, and bid document drafts — are generated by artificial intelligence (AI).
AI output is not legal, financial, or professional advice. It may contain errors, omissions, or inaccuracies. You must independently verify all AI-generated content against the original tender documents published on the official source portal before relying on it.
Specifically:
- Eligibility assessments are indicative only. You are solely responsible for confirming that you meet all eligibility criteria in the official tender notice.
- Win Probability Scores are statistical estimates derived from your profile data and historical patterns. They do not guarantee any outcome.
- Bid drafts are starting-point templates. You must review, edit, and verify them against the tender's RFP/NIT requirements before submission.
- Tender data is sourced from third-party government portals and may be delayed, incomplete, or contain errors as published at the source.
7. Intellectual Property
The Platform, including its software, design, logo, compiled AI enrichment, and proprietary matching algorithms, is the intellectual property of Tenderspot. Nothing in these Terms grants you any licence to our intellectual property other than the limited right to use the Platform as described herein.
Tender notices sourced from government portals are publicly available data and remain the property of the respective government bodies. We claim no ownership over the underlying tender content.
Content you provide to the Platform (company profile, saved notes) remains your property. You grant us a non-exclusive licence to use it to operate and improve the Platform.
8. Third-Party Data & Portals
Tender data displayed on the Platform is aggregated from public government portals. We strive to keep data current but do not guarantee that it is complete, accurate, or up-to-date. Government portals may change or remove tender information without notice.
Links to official government portals on the Platform are provided for your convenience. We are not responsible for the content, availability, or accuracy of those external sites.
9. Disclaimers of Warranty
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
We do not warrant that: (a) the Platform will be uninterrupted or error-free; (b) any tender data is accurate or current; (c) AI-generated outputs are suitable for your specific bidding requirements; or (d) use of the Platform will result in winning any tender.
10. Limitation of Liability
To the maximum extent permitted by applicable Indian law, Tenderspot and its founders, employees, and service providers will not be liable for:
- Any loss of profits, revenue, contracts, or business opportunities arising from your use of the Platform.
- Any inaccurate AI output, missed tender deadlines, or disqualified bids.
- Any indirect, incidental, consequential, or punitive damages.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform will not exceed the amount you paid us (if any) in the three months preceding the claim, or ₹1,000, whichever is greater.
Nothing in these Terms excludes liability for fraud, gross negligence, or any matter that cannot be excluded by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Tenderspot and its founders, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of: (a) your use of the Platform; (b) your violation of these Terms; (c) any bid document submitted by you to a government portal; or (d) any infringement of a third party's rights by you.
12. Termination
You may close your account at any time by emailing us at support@tenderspot.in.
We may suspend or permanently terminate your access to the Platform, without prior notice, if we reasonably believe you have breached these Terms, misused the Platform, or if required to do so by law.
Sections 6 (AI Disclaimer), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Governing Law) survive termination.
13. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the Platform will be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.
Before initiating any formal dispute, you agree to attempt to resolve the matter informally by emailing support@tenderspot.in. We will try to resolve your concern within 30 days.
14. Changes to These Terms
We may update these Terms at any time. Material changes will be notified to you by email or by a prominent notice on the Platform at least 7 days before the change takes effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
If you do not agree to any revised Terms, you must stop using the Platform and may close your account.
